Waste Clearance Highbury Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Highbury provides waste clearance and related services within the United Kingdom. By making a booking, accepting a quotation, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions.

Please read this document carefully before confirming a booking. If you do not agree with any part of these terms, you should not use our waste collection services.

1. Definitions

1.1 In these Terms and Conditions, the following expressions have the meanings set out below:

a. Company, we, us, our: refers to Waste Clearance Highbury, the provider of the waste collection and clearance services.

b. Customer, you, your: refers to any individual, business, landlord, managing agent, local authority or organisation that books or receives services from the Company.

c. Services: refers to any waste clearance, rubbish removal, waste collection, bulky waste removal, recycling, or related work carried out by the Company.

d. Premises: refers to the property, land, building, or location where the Services are to be carried out.

e. Waste: refers to the items, materials, and refuse that you ask us to remove as part of the Services, subject to the exclusions in these Terms and Conditions.

2. Scope of Services

2.1 We provide waste clearance and related services, including but not limited to household waste removal, commercial rubbish collection, bulky item disposal, garden waste removal and general waste management.

2.2 Our services are provided within our operational service area. While we primarily focus on local waste collection, we may agree to work outside our usual service area at our discretion and subject to additional charges.

2.3 We reserve the right to refuse any job that we reasonably believe to be unsafe, unlawful, unsuitable for our equipment, or outside the scope of our licence or expertise.

3. Booking Process

3.1 You may request a booking by telephone, email or through any booking system operated by us from time to time.

3.2 When you contact us, we will usually ask for details of the property, access arrangements, the type and approximate volume or weight of waste, and any special circumstances relevant to the booking.

3.3 Any quotation provided prior to arrival at the premises is an estimate only, based on the information supplied by you. The final price may be adjusted on site once our operatives have inspected the waste and assessed the work required.

3.4 A booking is only confirmed when we have: a. agreed a date and approximate time window for collection; and b. confirmed acceptance of your booking via telephone, email, text message or other written confirmation method used by us.

3.5 You are responsible for ensuring that the information you provide is accurate and complete. If the details supplied are inaccurate or incomplete, we may need to revise the quotation or decline to carry out the Services.

4. Access and Customer Obligations

4.1 You must ensure that we have safe, timely and reasonable access to the premises and to the waste to be collected. This includes providing any necessary access codes, permits, parking arrangements or authorisations.

4.2 You must ensure that the waste to be removed is clearly identified and that you, or an authorised representative, are present at the premises at the agreed time unless we have expressly agreed otherwise.

4.3 If access is not available, is unsafe, or is unreasonably restricted at the time of attendance, we may at our discretion: a. charge a wasted journey fee, and/or b. cancel the booking or reschedule for another time, which may incur additional charges.

4.4 You must not present for collection any waste that is prohibited by law or not permitted under these Terms and Conditions, including but not limited to hazardous or specialist waste, unless we have expressly agreed to handle such waste in advance and it is lawful for us to do so.

5. Waste Types and Exclusions

5.1 We operate in accordance with relevant UK waste regulations and licensing requirements. We are generally able to collect most forms of household and commercial waste, such as general rubbish, furniture, appliances, and green waste.

5.2 Unless we have agreed otherwise in writing, we do not collect: a. asbestos or materials containing asbestos; b. clinical, medical or infectious waste; c. chemicals, solvents, oils or industrial liquids; d. pressurised containers or gas bottles; e. explosives, ammunition or weapons; f. radioactive materials; g. paint, unless fully dried and in small quantities; h. any other hazardous or specialist waste requiring specific licensing or treatment.

5.3 If prohibited or hazardous items are presented for collection without prior agreement, we may refuse to remove them and may charge for any wasted journey or additional time required to handle the situation safely.

6. Pricing and Quotations

6.1 Prices are generally based on factors such as the type and volume of waste, the labour required, access conditions, loading time, and any disposal or recycling charges.

6.2 Any quotations provided in advance are indicative and not binding until our team has inspected the waste on site. We will confirm the final price before commencing work. If you do not agree to the revised price, we will not proceed and may charge a call-out or wasted journey fee.

6.3 All prices are quoted in pounds sterling and may be subject to applicable taxes where required by law.

7. Payments

7.1 Payment is due in full on completion of the Services, unless we have expressly agreed alternative payment terms in writing prior to the job.

7.2 We may accept various forms of payment, such as cash, card, bank transfer or other methods specified by us from time to time. We reserve the right to refuse certain payment methods at our discretion.

7.3 For business and account customers, separate payment terms may apply, as agreed in writing. If no separate agreement is in place, payment is due immediately upon completion of the Services.

7.4 If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate, together with reasonable administrative and recovery costs.

8. Cancellations and Rescheduling

8.1 You may cancel or reschedule a booking by contacting us as soon as possible.

8.2 If you cancel or reschedule with at least 24 hours notice before the agreed arrival time, no cancellation fee will usually apply.

8.3 If you cancel or reschedule less than 24 hours before the agreed arrival time, or if we attend and are unable to carry out the work due to your act or omission, we may charge a cancellation or wasted journey fee to cover our reasonable costs.

8.4 We will use reasonable endeavours to attend at the agreed time, but all times are estimates only. Circumstances such as traffic, weather, accidents or operational issues may cause delays. We will not be liable for any loss or inconvenience caused by a delay or need to reschedule, but we will endeavour to inform you as soon as reasonably practicable.

8.5 In the event of adverse weather conditions, safety concerns, or circumstances beyond our reasonable control, we may cancel or postpone the Services without liability. In such cases, we will offer to reschedule the booking at a mutually convenient time.

9. Performance of the Services

9.1 Our operatives will carry out the Services with reasonable care and skill and in accordance with applicable waste management regulations.

9.2 Unless agreed otherwise, our responsibility is limited to the physical removal of waste from the premises and transport to an authorised facility. We are not responsible for cleaning, decorating, minor repairs, or making good any areas beyond what is reasonable following a waste clearance.

9.3 We may take photographs of the waste before and after clearance for our records, compliance purposes and to evidence the work carried out. These images will be handled in accordance with applicable data protection laws.

10. Waste Transfer and Duty of Care

10.1 We operate as a licensed waste carrier or under the relevant exemptions, as required by law. Waste collected by us will be transported to authorised disposal or recycling facilities.

10.2 Where legally required, a waste transfer note or similar documentation will be created and retained by us in compliance with UK waste regulations and duty of care requirements.

10.3 Once the waste has been loaded onto our vehicle and we have left the premises, ownership of the waste passes to us. You will not have any further right to the waste or to request its return.

11. Customer Representations and Warranties

11.1 You represent and warrant that: a. you are the owner of the waste and premises, or have full authority from the owner to arrange the Services and transfer the waste; b. the waste does not contain prohibited or hazardous materials unless we have expressly agreed to handle such materials; c. all information you provide is accurate, complete and not misleading.

11.2 You agree to indemnify us against any loss, damage, claim or expense arising from your breach of these warranties or any unlawful, dangerous or improper presentation of waste for collection.

12. Liability and Limitations

12.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

12.2 Subject to clause 12.1, our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific job giving rise to the claim.

12.3 We will not be liable for: a. any indirect, consequential or economic loss, including loss of profits, business, contracts or goodwill; b. any loss arising from delays, cancellations or rescheduling, except to the extent caused by our deliberate misconduct; c. any damage to items or property that results from inherent defects, structural weakness, poor installation, or pre-existing conditions; d. any loss or damage arising where you have failed to comply with these Terms and Conditions or have not provided accurate information.

12.4 You are responsible for removing or safeguarding any valuable or fragile items before we commence work. We will not be responsible for loss of or damage to items that should reasonably have been removed or protected in advance.

13. Complaints

13.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing full details of your concerns.

13.2 We will investigate complaints in a fair and timely manner and, where appropriate, will propose a resolution. Any remedy offered will be at our discretion, having regard to these Terms and Conditions and applicable law.

14. Data Protection and Privacy

14.1 We may collect and process personal information about you in connection with your booking and the performance of the Services. This may include your name, contact details, address, payment details and any other information reasonably required to carry out the work.

14.2 We will handle your personal data in accordance with applicable data protection legislation in the United Kingdom and will only use your information for legitimate business purposes, such as administering your booking, processing payments, managing our accounts and improving our services.

15. Variation of Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, legal requirements or best practice.

15.2 The Terms and Conditions in force at the time of your booking will apply to that particular job, unless we have expressly agreed otherwise with you in writing.

16. Severability

16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between you and us in relation to the Services and supersede any prior representations, understandings or agreements, whether written or oral.

18. Third Party Rights

18.1 A person who is not a party to these Terms and Conditions shall have no right to enforce any of their provisions under the Contracts Rights of Third Parties Act 1999.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

19.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

By confirming a booking or allowing our operatives to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
